Fundamental Fairness First!

We seek your endorsement of this petition on behalf of the men and women who have been wrongfully incarcerated for thirty years or more, and one individual for 57 years for Erroneous Felony Murder Convictions! 

What Is Felony Murder?
It is the loss of life which occurs during the commission of a Felony Category Crime, for example a robbery. However a felony murder conviction requires proof of MALICE by the prosecution. When Malice is assumed based on participation in the felony by the prosecution then the conviction is erroneous, wrongful, and illegal! Prior to November 24, 1980 the Michigan Felony Murder Law contained Judical Conflicts. The Michigan Supreme Court intervened and corrected the Judicial Conflicts in their corrective Aaron Ruling effective November 24, 1980.

The Michigan Supreme Court Aaron Ruling clarified that MALICE has to be proven by the prosecution. If not then the respective Governor has the authority and power to execute COMMUTATIONS on behalf of the erroneous felony murder convictions that merit the application of the Aaron Ruling of November 24, 1980.

Example of Felony Murder Incident:
A girl and her boyfriend rob a store, and they are apprehended in the process. The girl is handcuffed and sitting in the police car. The boyfriend wrestles with the police officer, grabs the officer's gun, and fatally shoots the police officer. The prosecution did not prove MALICE, but based solely on her participation in the Enumerated Felony, she also received a life sentence without the possibility of parole. In Michigan make no mistake about it--Life sentences without the Possibility of Parole, Means Life Without Parole!! Because MALICE is an essential legal element of Felony Murder, when MALICE is not proven, it is not Felony Murder but a lesser offense!

The Michigan Supreme Court Ruling of November 24, 1980 clarified malice could not be assumed by participation during the underlying  felony, but that separate findings of Malice must be made regarding the death. Unfortunately, the Michigan Supreme Court Aaron Ruling applied the ruling to the 3 cases before it and to all future cases,
leaving the remedy for the prior all other Erroneous Felony Murder Convictions to the legislature and to the respective Governor.  The Governor has the power to grant commutations based on the cases that are deserving the Aaron Ruling.
